By purchasing any audio asset (including but not limited to beats, instrumental tracks, loops, acapellas, or samples) from this platform, the purchasing individual or entity (hereinafter referred to as the “Licensee”) legally enters into a binding agreement with the producer label THEFOR1 (hereinafter referred to as the “Licensor”).
The specific rights transferred depend entirely on the license model selected at the time of purchase: either a General Non-Exclusive Lease or a General Exclusive Rights Agreement.
2. Delivery & Audio Specifications
Upon successful payment validation and confirmation, the Licensee will instantly receive complete digital download access to fully untagged audio assets cleared of all vocal watermarks. For the Lease option, files are delivered in:
High-quality MP3 format (320kbps) High-quality WAV format (24-bit)
For the Exclusive option, delivery includes:
High-quality MP3 format (320kbps)
High-quality WAV format (24-bit)
Individual Track Stems/Layers (where applicable) for professional mixing, arrangement, and mastering purposes.
3. General Non-Exclusive Lease Terms
If the Licensee purchases a Basic Lease option, the following terms and restrictions apply:
Streaming Caps
The Licensee holds the right to distribute their finished commercial project across major digital audio streaming platforms (such as Spotify, Apple Music, SoundCloud, Tidal, Deezer, and similar services) up to a maximum limit of 50,000 streams combined across all platforms.
If cumulative streams exceed this 50,000 threshold, the license automatically expires, and a compulsory license upgrade is required to maintain lawful commercial distribution.
Video Synchronization
Synchronization of the licensed asset within video content hosted on platforms such as YouTube, TikTok, Instagram, Twitch, and similar services is permitted up to a maximum limit of 50,000 views combined across all platforms.
All revenue generated within the permitted stream/view limitations belongs solely to the Licensee.
Ownership Preservation
All copyrights, underlying material rights, publishing rights, and intellectual property rights remain 100% owned by THEFOR1.
The Licensor retains full rights to continuously lease, sell, or license the exact same asset to other parties.
4. General Exclusive Rights Terms (Full Ownership)
If the Licensee purchases Exclusive Rights, the following premium privileges apply:
Unlimited Distribution
The buyer is granted 100% unlimited commercial distribution rights.
There are absolutely no limits, caps, or thresholds on:
Audio streams
Album sales
Video views
Radio broadcasting
Commercial monetization worldwide
Total Transfer & Zero Royalties
100% of the material copyright, intellectual property rights, publishing rights, and ownership of the purchased asset are irrevocably transferred to the buyer.
The original producer/label (THEFOR1) retains:
0% royalties
0% publishing shares
0% performance earnings
0% mechanical royalties
All future revenue generated from the purchased asset belongs entirely to the buyer.
Permanent Store Removal
Upon execution of an Exclusive Rights purchase, the underlying file will be permanently removed from the public store catalog.
The Licensor guarantees that the specific file will never again be leased, licensed, sold, or distributed to any other party in the future.
5. Digital Rights Management & Content ID Restrictions
Under a Lease License
The Licensee is strictly prohibited from registering the underlying asset or their final song with any automated digital rights fingerprinting systems or copyright management networks, including but not limited to:
YouTube Content ID
Facebook Rights Manager
TikTok Rights Management systems
Such registration blocks other lawful leaseholders from using the same asset and directly violates this agreement.
Under an Exclusive Rights Agreement
The buyer holds the absolute and unrestricted right to register the final composition/song with:
Automated copyright protection systems
Digital rights distributors
Performance Rights Organizations (PROs)
including YouTube Content ID and Facebook Rights Manager.
6. Credit Attribution Obligations
For Lease Holders:
The Licensee must provide proper credit to the creator in the finalized track title, metadata, video description, or media information using one of the following formats:
“Prod. by THEFOR1”
“Produced by THEFOR1”
“Sampled from THEFOR1”
For Exclusive Buyers:
No attribution is required.
The buyer has full authority to utilize the purchased asset without any legal obligation to credit THEFOR1 in titles, metadata, artwork, descriptions, or project information.
7. Prohibitions on Reselling
Under international copyright and intellectual property laws, the unauthorized resale, redistribution, duplication, re-uploading, sublicensing, or standalone distribution of the raw audio assets in their original or unmodified form is strictly prohibited and legally enforceable by THEFOR1.
8. Termination of Agreement
Violation of any terms stated within this agreement may result in immediate termination of the granted license rights at the sole discretion of the Licensor.
Upon termination, all granted commercial usage rights immediately become null and void.
9. Acceptance of Terms
By purchasing, downloading, or using any audio asset from thefor1.art, the Licensee acknowledges and agrees to all terms and conditions outlined within this agreement.
10. Governing Law
This agreement shall be governed and interpreted in accordance with applicable international copyright, intellectual property, and digital distribution laws.
